Federal appeals court strikes down California ban on gay marriage

A federal appeals court on Tuesday ruled California’s constitutional amendment to ban gay marriage was unconstitutional.

In a 2-1 decision, the appeals court upheld a lower court ruling that declared unconstitutional a proposition banning same-sex marriage that was approved by voters in November 2008.

The decision will not put an end to the national debate over gay marriage, and is likely to elevate the issue in the presidential election.

Proposition 8 sponsor Protect Marriage plans to appeal to a larger 9th Circuit panel, and if they lose there too, will likely appeal to the U.S. Supreme Court.
